Hey Alexana Terms & Conditions

These Terms and Conditions (“Agreement”) govern the relationship between Alexana Rotunda, operating as Hey Alexana, an independent travel advisor (“Travel Advisor”), and the individual purchasing travel services or the lead traveler on behalf of a group (“Client” or “you”).

By engaging Travel Advisor’s services, requesting itinerary planning, or making payment toward travel arrangements, you acknowledge that you have read, understand, and agree to the following Terms and Conditions.

1. Use of Travel Advisor Services

By using Travel Advisor’s services, Client represents and warrants that:

Client is at least 18 years of age and has the legal authority to enter into this Agreement.

Client is authorized to make travel arrangements on behalf of all travelers included in the booking.

All information provided to Travel Advisor is accurate and complete.

Client agrees to provide updated information promptly if changes occur.

Client agrees to comply with all terms and conditions imposed by travel suppliers associated with the booking.

Client is responsible for ensuring all travelers included in the booking understand and accept these Terms and Conditions.

Travel Advisor is an independent travel advisor affiliated with Fora Travel, Inc. (“Fora”), which serves as a host agency and technology platform.

Client understands and agrees that:

Travel Advisor operates an independent business.

Travel Advisor is not an employee or representative of Fora.

Fora is not a travel service provider and does not operate or control travel services.

Fora is not a party to this Agreement.

Client agrees that no claims or liability shall be brought against Fora for matters arising from travel arrangements facilitated by Travel Advisor.

2. Independent Travel Advisor Status

Travel Advisor provides professional travel planning services which may include researching, designing, and booking travel arrangements such as:

Hotels and accommodations

Flights and transportation

Cruises and tours

Activities and excursions

Dining reservations and experiences

Other travel-related services requested by Client

Travel Advisor may charge a planning or service fee, which will be communicated and agreed to in writing prior to beginning itinerary development.

All planning or service fees are non-refundable and must be paid before Travel Advisor begins work.

3. Travel Planning Services and Fees

All travel proposals, itineraries, recommendations, and related materials prepared by Travel Advisor are the intellectual property of Travel Advisor.

These materials are provided exclusively for Client’s personal use in connection with booking travel through Travel Advisor. Client agrees not to reproduce, distribute, share, or use these materials to book travel arrangements through another agency, advisor, or directly with suppliers without the written consent of Travel Advisor.

Planning fees compensate Travel Advisor for professional expertise and research and do not grant permission to use the itinerary to book travel independently.

Itinerary Ownership and Use

Travel Advisor’s planning services include a reasonable number of itinerary revisions to refine Client preferences.

Extensive revisions, significant changes to travel dates or destinations, or planning requests outside the original scope of the trip may require an additional planning fee.

Travel Advisor will notify Client before any additional fees are applied.

Itinerary Revisions

Client agrees to provide timely and accurate information necessary to complete travel arrangements.

Delays in providing requested information may result in missed reservations, limited availability, or increased pricing, for which Travel Advisor shall not be responsible.

Travel Advisor strives to respond to client communications within 24–48 business hours. Response times may be longer during weekends, holidays, or periods when Travel Advisor is traveling.

Client Communication

All travel components included in an itinerary proposal prepared by Travel Advisor are intended to be booked through Travel Advisor.

Booking through Travel Advisor allows Travel Advisor to:

Manage reservations and coordinate itinerary components

Apply preferred partner amenities or benefits when available

Advocate on Client’s behalf should issues arise during travel

Ensure the trip is cohesive and fully supported

Client agrees not to circumvent Travel Advisor by booking travel components included in Travel Advisor’s proposal directly with suppliers or through another agency.

4. Booking Through Travel Advisor

Travel Advisor’s ability to effectively manage and support Client’s travel arrangements depends on bookings being made through Travel Advisor.

Travel Advisor may have limited ability to assist with reservations or services booked independently by the Client and is not responsible for issues arising from independently booked travel components.

Independent Travel Arrangements

Travel Advisor acts solely as an intermediary between Client and independent travel suppliers including, but not limited to:

Airlines

Hotels and resorts

Cruise lines

Tour operators

Transportation providers

These suppliers are independent entities with their own management and policies.

Travel Advisor does not control supplier operations and is not responsible for supplier actions, including but not limited to:

Schedule changes

Price changes

Service failures

Cancellations or delays

Operational decisions

Supplier bankruptcy or closure

Client agrees to the terms and conditions of each travel supplier involved in the booking.

5. Travel Suppliers

All quoted prices are in U.S. dollars unless otherwise indicated.

Travel pricing is dynamic and subject to change until reservations are confirmed and payment has been processed.

Pricing, availability, and preferred partner amenities or perks are not guaranteed until bookings are confirmed by the supplier.

Client agrees to make all payments when due, either directly to the supplier or through the payment method designated by Travel Advisor.

Client confirms they are authorized to use any credit card provided for payment and agrees not to initiate chargebacks unless the purchased service was never provided or was materially misrepresented.

6. Pricing, Availability, and Payments

Client is responsible for carefully reviewing all itineraries, invoices, confirmations, and travel documents upon receipt.

Client must notify Travel Advisor of any discrepancies within 24 hours of receiving documentation.

Failure to report errors may result in supplier change fees or penalties, which will be the responsibility of the Client.

Review of Travel Documents

All travel bookings are subject to the deposit, cancellation, and modification policies of the individual travel suppliers.

If Client requests changes or cancellations after a booking has been confirmed:

Supplier penalties may apply.

Travel Advisor may charge an additional change or cancellation service fee.

All modification or cancellation requests must be submitted in writing via email.

Travel Advisor is not responsible for penalties resulting from late requests.

7. Changes, Cancellations, and Service Fees

Travel insurance is strongly recommended for all trips.

For trips with a total value exceeding $10,000 USD, travel insurance is required.

Travel insurance may provide protection for:

Trip cancellations

Travel delays

Medical emergencies

Lost luggage

Supplier disruptions

Other unforeseen circumstances

If Client declines travel insurance, Client assumes full financial responsibility for any losses associated with cancellations, interruptions, delays, or other travel disruptions.

8. Travel Insurance

Client is responsible for ensuring that all travelers possess valid travel documentation required for the trip, including:

Passports

Visas

Vaccination records

Entry permits

Many destinations require passports to be valid for at least six months beyond the travel date.

All traveler names must match government-issued identification exactly.

Travel Advisor may provide general guidance regarding documentation requirements; however, final responsibility rests with the traveler.

Travel Advisor is not responsible for denied boarding, denied entry, or travel disruptions resulting from improper documentation.

9. Traveler Responsibilities

Travel involves inherent risks including illness, injury, natural disasters, political instability, transportation disruptions, and communicable diseases.

Travel Advisor does not guarantee the safety of any destination.

Changes in government travel advisories or personal concerns regarding travel do not entitle Client to refunds unless permitted by supplier policies.

Client voluntarily assumes all risks associated with travel.

10. Travel Risks and Advisories

Travel Advisor acts solely as an intermediary for travel suppliers and has no control over their operations.

Travel Advisor is not liable for:

Personal injury

Property damage

Supplier service failures

Travel delays

Lost luggage

Cancellations or schedule changes

Financial losses caused by supplier actions

Client agrees to release Travel Advisor from liability related to services provided by third-party suppliers.

Any recovery from Travel Advisor for claims arising from this Agreement shall be limited to the amount of commission or fees actually received by Travel Advisor for the booking in question.

11. Liability and Limitation of Damages

Travel Advisor shall not be liable for failure or delay in performance due to events beyond reasonable control including but not limited to:

Natural disasters

Weather events

War or terrorism

Civil unrest

Pandemics

Government actions

Transportation disruptions

Supplier closures

Travel insurance is strongly recommended to protect against such circumstances.

12. Force Majeure

Travel Advisor will make reasonable efforts to assist Clients with travel disruptions during their trip.

However, many issues must be resolved directly with the travel supplier responsible for providing the service.

Travel Advisor cannot guarantee immediate resolution of travel disruptions and is not responsible for supplier response times or outcomes.

13. In-Trip Assistance

This Agreement is governed by the laws of the State of Colorado.

Any disputes arising under this Agreement shall be resolved in the courts located in Aurora, Colorado, and Client consents to the exclusive jurisdiction of those courts.

14. Governing Law

Any claim arising from this Agreement must be brought within 12 months following completion of the trip.

Client agrees to bring claims only in their individual capacity and not as part of a class action or representative proceeding.

Travel Advisor shall not be liable for punitive or exemplary damages.

15. Claims and Class Action Waiver

Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force.

Entire Agreement
This Agreement represents the entire understanding between Client and Travel Advisor regarding travel services.

Modifications
Travel Advisor reserves the right to update these Terms and Conditions at any time.

16. General Provisions

By booking travel through Travel Advisor, paying a planning fee, or making payment toward travel arrangements, Client acknowledges that they have read, understand, and agree to these Terms and Conditions.
